Industrialists in cotton, wood pulp paper, petroleum products, and many other chemically made commodities felt threatened. As a result, this all-encompassing law was passed that substantially dampened the immense progress Hemp was making. Unfortunately, this advanced a lot of chemically created and processed goods that don’t break down as swiftly and gently as Hemp does. It would be over 75 years until there was progress made in support of the research, progression, and sale of Hemp and all of its incredible benefits.
In 1970, the US government doubled down with the Controlled Substance Act, listing “cannabis” as a Schedule 1 drug. This put the nourishing Hemp plant alongside heroin, cocaine, and meth. Because hemp and marijuana were considered the same (despite having no THC high), this further deterred Federal advancements for Hemp.
Thankfully, on February 7, 2014, the Controlled Substance Act removed the federal restrictions for growing Hemp via the Farm Bill. This also removed it from the Drug Enforcement Administration’s (DEA) schedule of Controlled Substances. This permitted states that had already established legal manufacturing practices to institute additional Hemp research programs. As of December 2018, the Farm Bill further opened the progress of Hemp. This completely removed Hemp’s affiliation to Marijuana from the Controlled Substance List of definitions.
With the progress made in congress between 2014 and 2018 as it relates to Hemp, we have been able to do great things. Hemp and any derivatives such as CBD are federally legal as well as federally regulated. This has given room for so much advancement.
What does it mean to have the FDA regulate Hemp? According to the FDA’s official website: “...hemp products must meet any applicable FDA requirements and standards, just like any other FDA-regulated product. For example, FDA’s existing authorities over foods, dietary supplements, human and veterinary drugs, and cosmetics apply to hemp products to the extent such hemp products fall within those categories.”
With this, Hemp and CBD companies such as ours can make mental and physical health supporting products. That being said, the FDA has not officially “...approved a marketing application for cannabis for the treatment of any disease or condition.” The FDA has, however, approved three cannabis-related drug products (Marinol, Syndros, and Cesamet) and one cannabis-derived drug (Epidiolex).
We expect there will be continued progress with the approval and classification of potent and healing Hemp and CBD products through the FDA. Let’s just say, it’s obvious that the government is deeply aware of the incredible properties of CBD. Why else would they own multiple patents?
For example, in October 1999 the United States Patent 6,630,507 was filed for “Cannabinoids as antioxidants and neuroprotectants”. You can read the in-depth research via this link. The main takeaway is right at the top, though. It states the following:
“This new found property makes cannabinoids useful in the treatment and prophylaxis of a wide variety of oxidation-associated diseases, such as ischemic, age-related, inflammatory, and autoimmune diseases. The cannabinoids are found to have particular application as neuroprotectants, for example in limiting neurological damage following ischemic insults, such as stroke and trauma, or in the treatment of neurodegenerative diseases, such as Alzheimer's disease, Parkinson's disease, and HIV dementia.”
Equally, the National Center for Biotechnology Information has done a tremendous amount of research on the subject. In fact, there are over 3,700 articles on their website on the subject which can be viewed here - https://www.ncbi.nlm.nih.gov/pmc/?term=Cannabidiol+(CBD). This makes it beyond apparent that our government and medical societies are cognizant that Hemp/CBD contains tremendous healing properties. Hopefully, we’ll see full FDA approval for ingestibles and topicals soon. This way, all people may receive the healing properties of Hemp and CBD on a broader level.Nature’s Root produces our Hemp and CBD products from beautifully sourced and imported Hemp farms outside of the United States. Honestly, the process isn’t too bad! We are very grateful for this as it has allowed us to partner with incredible growers. These Hemp growers care so much about the quality of the Hemp and the protection of our planet in doing so.
There are regulations laid out available via the US Customs and Border Protection (CPB)and the Animal and Plant Health Inspection Service US Department Of Agriculture (USDA). In short, we are able to import Hemp Plants and Hemp Seeds through Canada and other countries. To do so, we must have “A phytosanitary certificate from the exporting country’s NPPO to verify the origin of the plant and to confirm no plant pests are detected.” Equally, we must maintain a PPQ 587 permit which is a permit to Import Plants or Plant Products. In short, we have to follow the rules laid out, keep our permits up to date, and anticipate inspections upon entry into the US. As we work with trustworthy vendors and operate above board, this isn’t an issue for us.

Now let’s break this down – Why has the hemp plant been suppressed? Hemp and marijuana come from the same plant – the L Sativa plant. The only difference is through U.S regulations which states hemp is defined by a .3% or below level of THC and marijuana above .3%.
To sum up the details of why hemp was indeed criminalized and outlawed under the Marijuana Tax Act of 1937. Now remember, cannabis acts as the umbrella to two different strains; marijuana grown for high counts of THC which is includes a psycho-active effect on the body and on the other side is hemp which is grown today with high counts of CBD which creates a NON-psychoactive effect but relieves pain, inflammation along with other various health benefits. Understanding that we have opinionated, bias news today, we can now relate with what was happening back in the early 1900s. Propaganda targeted negatively towards the cannabis plant instilling “fear” to indeed stay away. Then in 1970 under the Controlled Substance Act “cannabis” which is hemp and marijuana was considered a Schedule 1 drug alongside heroin, cocaine and meth. Seems interesting to criminalize a plant knowing that all government documents such as The Declaration of Independence and The Constitution are written on hemp paper and the government also holds three patents on its neuro-protective properties. In recent news on June. 26th 2018 the FDA approved a synthetic CBD for pharmaceutical distribution. Again, interesting!
Tides are turning - What’s the situation on hemp now?
Illegal to test or study under the Controlled Substance Act it wasn’t until February 7, 2014, President Barack Obama signed into place the U.S Farm Bill into place which states, a removal of federal restrictions aimed at growing industrial hemp and allows any states that have legalized its manufacturing to set up research programs to study the benefits of cultivating it. Now up against a revised Hemp Farm Bill of 2018 which is now moving on to the Senate floor would completely legalize hemp production including CBD usage. Continuing to make breakthroughs every day with this incredible plant – scientist and universities have been working hard to prove the positive theories that have been stated in studies by other countries for years and help the government and people understand better what we are working with.
